Man struck by car in Comox can’t file claim

Victim has lost the information given to him by the driver of the vehicle

A Comox man who was struck by a vehicle Sunday, May 26 at Goose Spit is not able to file an insurance claim because he lost the paper that contains pertinent information after the accident.

Around 4 p.m. that day in the beach parking lot, Brian Mayenburg was struck by a car that was backing up.

“It was so packed that day they had vehicles parked on both sides. I was walking/jogging through there (a lane in the middle of the lot). There was someone, I noticed, in a brand new black 4Runner with a bike rack on the back ready to turn out. I was about four or five feet behind him, and I looked away for a second. I thought I heard someone yell, and then, ‘Boom.’ I just got nailed.”

The impact knocked Mayenburg several feet across the lot. Upon impact, he projectile vomited, and his ears were ringing so loudly he could barely hear.

An elderly couple who witnessed the accident said his legs were as high as the back of the 4Runner.

“The driver came out with his girlfriend,” he said. “They were young. They looked really scared.”

In shock, Mayenburg told bystanders that he was fit to drive the short distance home to Torrence Road. But the elderly couple intervened, helping him write details of the accident on a piece of paper. They walked him back to his car and asked if they could drive him home, but he refused the offer.

“I don’t even remember driving home. I woke up a couple hours later thinking it was a dream.”

But when he went to move, his head was pounding. Mayenburg had a large bump on his head, along with other injuries. He sustained a mild concussion and continues to suffer migraines.

Amidst the confusion, he lost the paper with the driver’s information. As such, ICBC will not accept his claim.

Mayenburg hopes the driver, and the elderly couple, will contact him.

“I want to thank the couple for helping me out,” he said.
